UID: CHE-486.898.722 MWST

2. Governing Law and Jurisdiction
These Terms and Conditions, and any dispute or claim arising out of or in connection with them or their subject matter or formation, shall be governed by and construed in accordance with the law of Switzerland, in particular the Swiss Code of Obligations (Obligationenrecht, OR).
The exclusive place of jurisdiction for all disputes arising out of or in connection with these Terms and Conditions shall be the competent courts of the Canton of Zurich, Switzerland, subject to any mandatory statutory provisions to the contrary.
If you are a consumer resident in Switzerland, you retain the benefit of any mandatory consumer protection provisions applicable under Swiss law.
3. Course Description
The Reclaim Your Network Group Coaching Course is a six-week live online group coaching programme designed to support senior professionals in rebuilding and activating their professional network.
3.1 Format and Delivery
• The Course comprises six weeks of scheduled content and coaching sessions, delivered live online via video conferencing.
• Each live session is recorded. If a User is unable to attend a live session, a recording will be made available to them within a reasonable time thereafter.
• Course materials are provided digitally and may be downloaded by the User for personal use.
• The specific start date of each cohort is communicated to registered Users in advance of the Course commencing.
3.2 Access to Course Materials
Upon payment of the full purchase price (or the first instalment where a payment plan has been selected), the User will be granted access to the Course materials and sessions from the confirmed cohort start date.
Access to Course materials is granted on a lifetime basis for so long as Pipsy GmbH continues to operate. In the event that Pipsy GmbH permanently ceases trading, reasonable prior notice will be given to Users and the Owner will use reasonable endeavours to ensure Users retain access to downloaded materials already in their possession.
The Owner reserves the right to update, revise, or supplement Course materials from time to time. Such updates do not affect the User's entitlement to the Course as purchased.
3.3 Technical Requirements
To access the Course, Users require a stable internet connection and a device capable of supporting video conferencing and accessing online course materials. It is the User's responsibility to ensure their technical setup meets these requirements prior to purchase.
4. Pricing and VAT
The current price of the Course is displayed on the Pipsy GmbH website at the time of purchase. All prices are stated in Swiss Francs (CHF) and are inclusive of Swiss Value Added Tax (MWST) at the applicable rate.
The Owner reserves the right to vary the price of the Course between cohorts. The price applicable to a User is that confirmed at the time of their order submission. Price changes do not affect orders already confirmed.
Pipsy GmbH is registered for VAT in Switzerland under UID CHE-486.898.722 MWST.
Note for Users based outside Switzerland: Swiss VAT treatment for cross-border digital services may vary depending on your country of residence. Users are responsible for any additional taxes, duties, or levies applicable in their own jurisdiction.
5. Instalment Payment Plan
Where an instalment payment plan is offered, the following terms apply:
• The purchase price may be paid in three equal monthly instalments.
• The first instalment is due at the time of order submission. Subsequent instalments are due one calendar month and two calendar months after the date of the first payment respectively.
• Access to the Course is granted on the confirmed cohort start date, subject to the first instalment having been received.
• If any instalment payment fails or is not received by the due date, the entire outstanding balance shall become immediately due and payable. The Owner reserves the right to suspend or withdraw Course access until full payment is received.
• The total cost under the instalment plan is identical to the full payment price. No additional fee is charged for using the instalment option.
6. Intellectual Property
All content forming part of the Course — including but not limited to video recordings, written materials, worksheets, frameworks, templates, slide decks, and any other materials — is the exclusive intellectual property of Pipsy GmbH and is protected under applicable Swiss and international copyright law.
Upon purchase, the User is granted a personal, non-exclusive, non-transferable licence to access and use the Course materials for their own private, non-commercial purposes. This licence does not include the right to:
• Share, distribute, reproduce, or transmit any Course materials to any third party, whether in whole or in part, and whether for commercial purposes or otherwise;
• Use Course materials for training, facilitation, or coaching purposes with any other person or group;
• Share login credentials or access links with any third party;
• Record, capture, or redistribute live sessions without the express prior written consent of the Owner.
Breach of these intellectual property terms may result in immediate termination of the User's Course access without refund, and may give rise to claims for damages under Swiss law.
7. Limitation of Liability
7.1 No Guarantee of Outcomes
The Course is designed to provide coaching, tools, and frameworks to support professional networking and career development. The Owner does not guarantee any specific career outcome, employment result, salary outcome, or level of professional success as a result of completing the Course. Individual outcomes depend on a range of factors outside the Owner's control, including but not limited to the User's personal effort, individual circumstances, labour market conditions, and the application of skills learned.
7.2 Limitation of the Owner's Liability
To the fullest extent permitted by applicable Swiss law, the Owner's total liability to a User in connection with the Course — whether in contract, tort, or otherwise — shall not exceed the total amount paid by that User for the Course.
The Owner shall not be liable for any indirect, incidental, consequential, or special loss or damage arising out of or in connection with the Course or these Terms, including but not limited to loss of earnings, loss of opportunity, or loss of data.
7.3 Technical Availability
The Owner will use reasonable endeavours to ensure that live sessions and Course materials are available as scheduled. However, the Owner cannot guarantee uninterrupted availability and accepts no liability for losses arising from temporary technical unavailability, interruptions to live sessions caused by third-party platform issues, or force majeure events. Where a live session is materially disrupted, the Owner will make a recording available and/or schedule a replacement session at its reasonable discretion.
8. Right of Withdrawal — Swiss Specific Provisions
Switzerland is not a member state of the European Union. The right of withdrawal described in the general Terms and Conditions of Sale applies to Users who qualify as European Consumers under EU law. For Users resident in Switzerland, the following provisions apply:
Swiss law does not confer a statutory right of withdrawal on consumers for distance contracts in the same terms as EU law. Accordingly, purchases of the Course are final once the order has been submitted and confirmed, subject to the cancellation and refund policy set out below.
8.1 Cancellation and Refund Policy
• If a User cancels their enrolment more than 14 days before the confirmed cohort start date, they will receive a full refund of any amounts paid.
• If a User cancels their enrolment within 14 days of the confirmed cohort start date but before the Course commences, the Owner will offer a credit note to the value of amounts paid, redeemable against a future cohort of the Course.
• Once the Course has commenced (i.e. the cohort start date has passed), no refund or credit will be issued, except at the sole discretion of the Owner in exceptional circumstances.
8.2 Waiver of Digital Content Withdrawal Right (EU Consumers only)
For Users who do qualify as European Consumers, the following applies: by submitting their order, the User expressly consents to the Course content and materials being made available from the confirmed cohort start date, and acknowledges that access to digital content will begin on that date. The User acknowledges that by providing this consent, they waive their right of withdrawal in respect of any digital content made available to them from that date.
This waiver does not affect the cancellation and refund terms set out in clause 8.1 above.
9. Complaints and Dispute Resolution
The Owner is committed to resolving any concerns promptly and in good faith.
If you have a complaint regarding the Course or any aspect of your purchase, please contact the Owner in the first instance by e-mail at enquiries@pipsy.ch, setting out the nature of your complaint. The Owner will acknowledge receipt of your complaint within five working days and will use reasonable endeavours to provide a substantive response within 21 days.
Where a complaint cannot be resolved amicably, the parties agree to attempt mediation in good faith before commencing formal legal proceedings. The costs of any mediation shall be shared equally between the parties unless otherwise agreed.
Nothing in this clause limits either party's right to seek urgent injunctive or other interim relief from a competent court.
